Trade: Temporary continuation without qualified representation

Upon request, a business can be continued without a deputy for a period of one year after the death of the trader.

After the death of a trader, the trade may be charged

  • the surviving spouse or partner,
  • of the minor heir during the period of minority, or
  • of the administrator of the estate, guardian of the estate or executor

as a rule, only be operated by a deputy qualified in accordance with § 45 of the Industrial Code.

Upon request, the competent authority may allow the trade to be operated without a substitute for a period of one year after the trader's death.

Existing special regulations for individual trades (e.g. crafts, hospitality industry) remain unaffected by this.
