Playground equipment with the possibility of winning may only be set up at suitable locations with permission.

Traders may only set up gaming equipment with the possibility of winning (winning goods, winning money) if the competent authority has confirmed to them in writing that the installation site is suitable for this.

The permission you need for the installation and operation of such play equipment may be subject to conditions. The requirements may relate to the place of installation, insofar as this is necessary for the protection of the general public, the guests or the residents of the respective company property or the neighboring properties or in the interest of the protection of minors.

The exact provisions on installation sites are laid down in the Gaming Ordinance (SpielV).

A gaming device in which the profit consists in money (money gaming device) may only be set up

  • in tourist accommodation establishments or in the premises of pubs or restaurants where drinks or food are consumed on the spot,
  • in gambling halls or similar companies, or
  • in betting offices of licensed bookmakers.

For example, a gambling machine may not be set up at folk festivals, fairs, drinking halls, ice bars or in pubs or restaurants located on sports fields, sports halls, dance schools, bathing establishments or youth hostels.

The application can be made informally, it must contain the information on the whereabouts.
A site visit may be necessary if, for example, equipment is to be set up in the premises for the first time or the premises have changed.
