The family court annside the civil partnership at the request of one or both partners.

A civil partnership is annulled at the request of one or both life partners by a decision of the family court. Alternatively, the prerequisite for the annulment is that the life partners

  • have been living separately for at least one year and either both partners apply for annulment or the defendant agrees to the annulment, or
  • have been living apart for at least one year and it cannot be expected that a partnership can be restored, or
  • if the life partners have been living apart for three years.

In addition, the court may annul the civil partnership, irrespective of the duration of the separation, if the continuation of the civil partnership would be unreasonable hardship for the applicant for reasons that lie in the person of the other partner.
