Expropriation is a form of state access to land or to the rights to land.

Expropriation is a form of state access to land or rights to the land. Expropriation is only permitted if the land is absolutely necessary for the realization of a project. The project must serve the common good (e.g. road construction).

Expropriation is only permitted against compensation. This is usually done in the form of money, exceptionally the granting of substitute land is possible. Compensation for land is based on its market value. As a rule, valuation reports of the expert committees for property values or of publicly appointed and sworn experts are used to determine this. If there are plants or growth on the land, additional valuation reports may be required, for example by agricultural experts.
