Real estate agents, loan brokers, property developers, construction supervisors and property managers according to § 34c GewO - Permit Unfortunately this specification of service has not yet been completely translated.

Anyone who wants to work as a real estate, loan agent, property developer or construction supervisor needs a permit.

According to § 34c sec. 1 GewO, real estate agents, loan intermediaries, property developers, construction supervisors and residential property managers require a permit. This permission is granted in Schleswig-Holstein by the Chambers of Industry and Commerce.

  • Real estate agent is anyone who commercially brokers the conclusion of contracts for land, rights equivalent to real estate, commercial premises or residential premises or wants to prove the opportunity to conclude such contracts (§ 34c para. 1 no. 1 GewO).
  • A loan intermediary is someone who wants to broker the conclusion of loan agreements on a commercial basis (with the exception of real estate consumer loan agreements since 21 March 2016) or to prove the opportunity to conclude such contracts (§ 34c para. 1 no. 2 GewO).
  • A property developer is someone who, as a builder, prepares or executes construction projects in his own name for his own account or for the account of others and wants to use assets of purchasers, tenants, tenants or other beneficial owners or applicants for acquisition or usage rights (§ 34c para. 1 no. 3a GewO).
  • A construction supervisor is anyone who wants to economically prepare or carry out construction projects in the name of and for the account of others (§ 34c para. 1 no. 3b GewO).
  • Residential property manager is anyone who wants to manage the joint ownership of apartment owners within the meaning of § 1 paragraph 2, 3, 5 and 6 of the Condominium Act or for third parties tenancies over residential premises within the meaning of § 549 of the BGB.

For legal entities:

  • Excerpt from the commercial register,
  • Extract from the Central Trade Register for submission to an authority (document type 9) for the company as well as for all managing partners,
  • Certificate of good conduct for submission to an authority (document type 0) for all managing partners,
  • Certificate in tax matters from the tax office for the company,
  • Copy of the current permission § 34c GewO (in case of extension).

For natural persons:

  • Information from the Central Trade Register for submission to an authority (document type 9),
  • Certificate of good conduct for submission to an authority (document type O),
  • Certificate in tax matters from the tax office,
  • Copy of the current permission § 34c GewO (in case of extension).

In addition, a query is carried out by the IHK at the local court (insolvency register and debtor register).
