Registration in the register of craftsmen

The Crafts Code (HWO) distinguishes between

  • the craft sector subject to authorisation,
  • the craft trade, which is free of authorisation, the craft-like trade.

Do you intend to independently operate a craft subject to licensing as a standing trade? Then it is necessary that you have your business registered in the craft register. Can be registered

  • natural and legal persons, and
  • Partnerships.

A standing trade includes any commercial enterprise whose activity is not attributable to the travel trade or market traffic. A commercial establishment is not a prerequisite.

You or the person you appoint to manage the business must have the personal requirements for registration in the register of craftsmen if you

  • set up a standing business, or
  • participate in a business, or
  • want to become self-employed together with a partner.

Do you independently operate a craft subject to licensing as a standing trade? Then you have to have your business registered in the craft register. Can be registered

  • natural and legal persons, and
  • Partnerships.

A standing trade includes any commercial enterprise whose activity is not attributable to the travel trade or market traffic. A commercial establishment is not a prerequisite.

A commercial enterprise is a business of a craft subject to licensing if it is operated by a craft and completely comprises a trade. The trade must be listed in Annex A to the Crafts Code (HwO). It is also possible to carry out activities that are essential for this trade (essential activities).

You or the person you appoint to manage the business must have the personal requirements for registration in the register of craftsmen if you

  • set up a standing business, or
  • participate in a business, or
  • want to become self-employed together with a partner.

for sole proprietorships:

  • Completed application form
  • certified copy of the identity card or a comparable identification document
  • Proof of the qualification (certified copy of the master craftsman's certificate, technician's certificate, etc.) of the holder

in the case of civil law companies ( GbR):

  • Completed application form
  • certified copies of the identity card or a comparable identification document of the shareholders or persons authorised to represent
  • Copy of the articles of association
  • Proof of qualification (copy of master craftsman's certificate, technician's certificate, etc.) of the shareholders

in the case of a GmbH, unternehmergesellschaft (haftungsbeschränkt), AG, OHG, KG, GmbH & Co. KG and other domestic or foreign companies:

  • Completed application form
  • certified copies of the identity card or a comparable identification document of the shareholders or persons authorised to represent
  • For proof of the entrepreneurial legal form:
    • at the company's headquarters in Germany:
      • in the case of companies entered in a register: extract from the commercial register or the partnership register
      • otherwise a copy of the articles of association (e.g. in the case of a partnership under civil law (GbR))
    • in the case of the company's registered office abroad: documents from the country of residence proving the legal form.

In the case of legal entities (GmbH, corporate companies, AG, registered cooperatives), you only have to fill out the application form for the legal entity itself. All personal documents must be submitted for all natural persons authorised to manage the business (e.g. personal documents).

In the case of partnerships (GbR, KG, OHG, PartG, GmbH & Co. KG), each managing partner must report the business, fill out an application and submit all personal documents.

in the case of employment of a farm manager:

  • Farm Manager's Declaration
  • Proof of the management activity (copy of the employment contract of the farm manager)
  • Proof of the qualification of the plant manager (certified copy of master craftsman's certificate, technician's certificate, exemption permit, etc.)

Hint: If you hire a second person as manager, you must also provide the farm manager's declaration and proof of the farm manager's activity for them as well.

The Crafts Code also provides for provisions according to which you or your management as

  • Diplom-Ingenieur or Diplom-Ingenieurin or
  • Engineer or
  • with a German state or state-recognised examination equivalent to the master craftsman's examination

can be entered in the register of craftsmen.

Note: If you do not meet this requirement, you can apply for exemptions in certain cases.

Prerequisites are:

  • the master craftsman's examination
    If you or your plant manager have successfully passed the master craftsman's examination in a craft subject to approval, you will be entered in the register of craftsmen of your Chamber of Crafts:
    • with the craft you want to practice or
    • in a craft subject to authorisation related to it

Note: If you do not meet this requirement, you can apply for exemptions in certain cases.

  • Registration in the Register of Craftsmen - Exceptional permit If you or your farm manager have not passed a master craftsman's examination, you may be able to obtain the entry in the register of craftsmen via an exemption permit.
  • Registration in the Register of Crafts - Applying for an exemption for EU/EEA citizens and EU/EEA citizens If you or your farm manager are nationals of a Member State of the European Union (EU) or a state party to the Agreement on the European Economic Area (EEA) or Switzerland, you may be able to obtain entry in the Crafts Register via an exemption permit in accordance with the Crafts Code.
  • Registration in the register of craftsmen - Apply for exercise authorization Without a master craftsman's examination, you or your farm manager may be able to obtain a right to exercise.
  • Registration in the Register of Craftsmen - Apply for the right to practise an additional craft If you operate a craft subject to authorisation, you can also use this right to practise work in other crafts subject to authorisation.

The Crafts Code also provides for provisions according to which you or your management as

  • Diplom-Ingenieur or Diplom-Ingenieurin or
  • Engineer or
  • can be entered in the register of craftsmen with a German state or state-recognised examination equivalent to the master craftsman's examination.

The prerequisite is that the study or school focus of your examination corresponds to the craft to be registered.

Attention: You may only practice the craft subject to approval that has been registered. If several crafts subject to authorisation are exercised, each of these crafts subject to authorisation must normally be registered in the register of craftsmen.

In order to have your company registered in the craft register, it is necessary that you submit an application.With the entry in the register of craftsmen is the issuance of a craft card. With the craft card you can later identify yourself as a registered craft business.
