Construction project Advance notice

For every construction site where the estimated duration of the work is more than 30 working days and during which more than 20 employees work at the same time, or the scope of the work is expected to exceed 500 person-days, the competent authority must be noted at least two weeks before the construction site is set up, a prior notice containing at least the information set out in Annex I to the Construction Site Ordinance. The advance notice must be displayed visibly on the construction site and adapted in the event of significant changes.

Mandatory information according to Annex I BaustellV: location of the construction site, name and address of the client, type of construction project, name and address of the third party responsible in place of the client, the name and address of the coordinator, the expected start and duration of the work, the expected maximum number of employees on the construction site, the number of employers and contractors without employees who are likely to work on the site, Indication of the employers and entrepreneurs without employees already selected.


Preconditions
At the latest two weeks before the installation of a construction site where the estimated duration of the work is more than 30 working days and during which more than 20 employees work at the same time, or the scope of the work is expected to exceed 500 person-days.

Hints
Rule of thumb: Advance notice is usually required if the construction activities require a deployment of at least 4 workers over a period of more than 6 months. § 7 para. 1 no. 1 BaustellV: An administrative offence is acted by anyone who intentionally or negligently does not provide the competent authority with prior notice, not correctly, not completely or not in time.
In accordance with § 4 BaustellV, the client or his commissioned third party must check whether one of the conditions according to § 2 (2) BaustellV is fulfilled. If so, the advance notice must be sent to the competent authority in good time, displayed visibly on the construction site and adapted in the event of significant changes.
