Assumption of funeral costs

The necessary costs of a funeral are covered by the social welfare office, insofar as it cannot be expected of those obliged to do so to bear the costs.

According to the Funeral Act (BestG), the adult relatives of the deceased person are obliged to arrange for the funeral in the following order:

  1. the spouse or partner,
  2. the children,
  3. the parents,
  4. the other person with custody,
  5. the siblings,
  6. the grandparents,
  7. the grandchildren

Must be clarified with the competent authority on a case-by-case basis.

A payment from the social assistance institution is only possible if

  • the estate of the deceased is not sufficient
  • and the debtors (heirs, maintenance debtors or other relatives) are not in a position to bear the funeral costs from their own resources (income and assets).

The regulations for this benefit can be found in Chapter 9 of the Social Code XII under the title "Assistance in other life situations".
