There is a special protection against dismissal against a woman

  • during their pregnancy,
  • up to the end of four months after a miscarriage after the twelfth week of pregnancy,
  • until the end of their period of protection after childbirth, but at least until the expiry of four months after childbirth, and
  • from the date of parental leave is required, starting no earlier than eight weeks before the beginning of parental leave until the child's age of three years of age and not later than 14 weeks before the commencement of parental leave between the third birthday and the completed eighth year of the child's life.

This protection against dismissal for women begins with the notification of their pregnancy to the employer and applies only if the employer was aware of the pregnancy at the time of termination or if it is notified to him within two weeks of receipt of the termination. Exceeding the time limit is harmless if it is based on a reason for which the woman is not responsible and the communication is made immediately. With regard to parental leave, the protection against dismissal applies from the date on which parental leave has been requested.

Terminations are only permitted with the approval of the competent authority.
