§ 12(1) prostitute protection law (ProstSchG):
The operation of a prostitution centre requires the permission of the competent authority. The permission can be limited in time.
The licence shall be renewed on application if the conditions governing the granting of the licence continue to apply.

§ 12(2) prostitute protection law (ProstSchG):
The permit for the operation of a prostitution centre is granted at the same time for a specific operating concept and for certain structural facilities, installations and rooms located therein.

If the conditions are met, there is a legal right to the granting of a permit to operate a prostitution business.

For a permit pursuant to § 12 paragraph 1 of the Prostitute Protection Act, the following documents must be attached to the application in accordance with § 12 paragraph 5 of the Prostitute Protection Act:

1. the operating concept;
2. the other necessary documents and information on:
proof of the existence of the permit requirements as well as

3. The name, date of birth and address of the person for which:
the permission is requested, or with a legal person
or association of persons whose business name, address, number of the register sheet in the commercial register and their registered office.

The licensing authority informs about which additional documents are to be submitted.

According to §§ 14,15 ProstSchG, the applicant or the person designated as deputy or management must have the necessary reliability.
As a rule, the required reliability is not given if the person fulfils a characteristic listed in §15 paragraph 1 ProstSchG.

According to § 16 paragraph 1 ProstSchG, the operating concept describes the essential characteristics of the company and the precautions for compliance with the obligations under this Act.

The granting of a permit requires an application:

- the competent authority must submit an application using the required forms, together with the necessary documents,
- The submitted documents are checked for completeness and consistency.
- If necessary, documents will be requested.
- If necessary, a local appointment will be arranged.
- A personal conversation is arranged regularly.
- If all the conditions are met, permission will be granted. The applicant receives the permission notice.
Otherwise, a rejection notice will be issued.
