If you have lost your job in the mining industry, you may be entitled to a miners' compensation benefit (Knappschaftsausgleichsleistung, KAL) under certain conditions.

If you lose your job in mining through no fault of your own, for example due to operational restrictions, the miners' compensation benefit (KAL) can support you financially.

The KAL helps older miners who are affected by the difficult labour market situation until the start of their old-age pension. You will receive KAL until you switch to another pension and until you reach the standard retirement age at the most.

The amount of your KAL is calculated in the same way as the pension due to full reduction in earning capacity. However, there are the following special features:

  • Only your entitlements under the miners' pension insurance scheme will be taken into account. If you have acquired further entitlements under the general pension insurance scheme, for example through work outside the mining industry, these will not be taken into account. The contributions you pay to the general pension insurance will only be taken into account for a later pension, for example for your old-age pension.
  • Performance bonuses for permanent underground work are also not taken into account.
  • In contrast to the calculation of a pension due to reduced earning capacity, the KAL does not include an additional period.

The amount of your KAL pension is therefore determined only by the portion of your entitlement from the miners' pension insurance.

As a KAL recipient, it is advantageous for you to receive your old-age pension at the earliest possible time. In contrast to the KAL, you will then also receive

  • the benefit supplement for permanent underground work and entitlements
  • entitlements from the general pension insurance are also taken into account.

The time during which you receive KAL is taken into account as a credit period in your pension. This means that you will receive a higher pension. The following old-age pensions are possible after a KAL:

  • the old-age pension for miners who have worked underground for many years,
  • the old-age pension for severely disabled persons,
  • the old-age pension for those insured for many years,
  • the standard old-age pension or
  • the old-age pension for persons insured for a particularly long period.

Which old-age pension is suitable for you after the KAL depends on which eligibility criteria you meet. The Knappschaft-Bahn-See will advise you on this.

If you receive the KAL,

  • you may earn up to EUR 6,300 in addition to your pension. Partial payment, as in the case of old-age pensions, is excluded.
  • you cannot receive unemployment benefit I or unemployment benefit II during this time.

If you take up a new job in a miner's company, you can no longer receive KAL. This applies regardless of how much you earn.

  • valid identity card or passport
  • Evidence that is not recorded in the insurance history, for example:
    • Offset certificates
    • Evidence of periods of training
    • Proof of unemployment
    • Proof of periods of illness
  • when another person makes the application:
    • Power of attorney or
    • Order of the court.

Preconditions

  • You are at least 55 years old.

Either you have:

  • completed an insurance period of at least 25 years of continuous underground work

or you have

  • completed an insurance period of at least 25 years for miners' pension insurance,
  • worked underground, and
  • given up the last underground job for health reasons.

In addition, you must have been dismissed through no fault of your own, for example due to

  • operational restriction,
  • layoff due to shutdown,
  • amalgamation of undertakings or
  • other rationalisation measures.

Exception: You can also leave the miners' company voluntarily if you have

  • have completed an insurance period of 25 years of continuous underground work, and
  • you had to change your underground employment after 31 December 1971 for health reasons (reduced occupational capacity in mining).

If you have received an adjustment allowance, these periods count towards your insurance period. For this to be the case, you must have last worked underground before receiving the adjustment allowance.

You can apply for miners' compensation benefits (KAL) in writing, in person, or online.

Written pension application:

  • Download the miners' compensation benefit application form from the German Pension Insurance website. Fill out the form completely and gather the required documents.
  • You can submit your completed and signed application together with the required documents to either
    • send it by post to the Knappschaft-Bahn-See or
    • hand it in at one of the local advice centres.
  • When your pension application has arrived, you will receive a confirmation of receipt.
  • The Knappschaft-Bahn-See will check the application for completeness and, if necessary, request any missing documents.
  • The Knappschaft-Bahn-See will check that the conditions for your pension entitlement and your insurance history are complete. If necessary, it will clarify gaps in your insurance history.
  • The Knappschaft-Bahn-See will also clarify other matters, such as your health insurance relationship, whether you earn additional income or receive an accident pension.
  • If you are entitled to the KAL at the desired start of your pension, you will receive a pension notice with details of the start date, the start of the current payment and the amount. You will also be informed of your rights and obligations.
  • If you are not entitled to the KAL at the requested pension start date, you will receive a rejection notice stating the reason for the rejection.

Pension application via online procedure:

  • Go to the online portal of the German Pension Insurance and log in. You can use your signature card, your identity card with electronic proof of identity or your electronic residence permit for this purpose.
  • Fill out the miners' compensation form and upload the necessary documents. Then submit your pension application online.
  • When your pension application has arrived, you will receive a confirmation of receipt.
  • The Knappschaft-Bahn-See will check the application for completeness and, if necessary, request any missing documents.
  • The Knappschaft-Bahn-See will check the conditions for your pension entitlement and your insurance history for completeness. If necessary, it will clarify gaps in your insurance history.
  • The Knappschaft-Bahn-See will also clarify other matters, such as your health insurance relationship, whether you earn additional income or receive an accident pension.
  • If you are entitled to the KAL at the desired start of your pension, you will receive a pension notice with details of the start date, the start of the current payment and the amount. You will also be informed of your rights and obligations.

A person you trust can also submit the application on your behalf. Please submit a corresponding power of attorney to the Knappschaft-Bahn-See. As long as the power of attorney is valid, the Knappschaft-Bahn-See will only contact your authorized person.
