Extension of the residence permit after a positive asylum decision

If a positive decision is issued after the asylum procedure, the applicant receives a temporary residence permit (residence permit in accordance with Section 25 (1), (2) or (3) AufenthG - residence for humanitarian reasons).

An asylum procedure is approved if one of the four forms of protection is available:
  • Persons entitled to asylum (Section 25, Subsection 1, Residence Act) and recognized refugees (Section 25, Subsection 2, 1st alternative Residence Act) generally receive a residence permit limited to 3 years
  • Subsidiary protection (Section 25, Paragraph 2, 2nd alternative Residence Act) generally grants a residence permit limited to 2 years
  • The ban on deportation (Section 25, Paragraph 3 of the Residence Act) generally grants a residence permit limited to 1 or 3 years

The Ministry of Internal Affairs and Sport - Office for Migration (BIS / M) is responsible for the first issue of a residence permit after a positive asylum decision.
This also applies to the first issue of family reunification for refugees (residence permit according to § 30 and § 32 AufenthG)

The district immigration services are generally responsible for extending these residence permits.
Basically:
  • Current electronic residence permit (eAT)
  • National passport or travel document
  • 1 biometric passport photo (not older than 6 months)
  • Pay slips for the past three months.
    • In the event of unemployment: current SGB II notification or social welfare notification.
§ 30 AufenhG (spouse) additionally:
  • Current eAT
  • National passport or travel document
  • National passport or travel document and eAT of the spouse (with a residence permit in accordance with Section 25 Paragraph 1 or Paragraph 2 or Paragraph 3 of the Residence Act)
  • Marriage certificate
  • rental contract
  • Proof of the current rent
  • Language certificates
Section 32 AufenthG (children) additionally:
  • current electronic residence permit (eAT)
  • National passport or travel document
  • National passport or travel document and electronic residence permit (eAT) of the parents
  • Birth certificate
  • Parents' marriage certificate
  • School certificate stating the desired school-leaving qualification
  • Language certificates
If the required documents are not available, this must be discussed on site.

Preconditions

Existence of a residence permit in accordance with Section 25 (1) or (2) or (3) AufenthG; for family members with a residence permit according to § 30 or 32 AufenthG.

  • In the event of a positive decision on your application:
    • The biometric data are recorded.
    • The electronic residence permit (eAT) is ordered from Bundesdruckerei GmbH.
    • Another appointment will be made to receive the new electronic residence permit (eAT) and, if applicable, the travel document.
    • The new electronic residence permit (eAT) and, if applicable, the travel document will be issued. Collection is also possible by a third party on presentation of a power of attorney.
