The business registration must be made at the same time as the start of operations. A trader is anyone who has a full-time or part-time self-employed, profit-making and long-term activity. Exceptions are so-called freelance work (e.g. doctor, architect, tax advisor), Primary production (e.g. agriculture and forestry), higher quality personal services and mere administration of one's own assets. In the case of partnerships (e.g. BGB companies, OHG, KG), the shareholders authorized to manage the company are to be regarded as traders. The registration of a trade can also be done by a person who can be shown to have been authorized and identified in writing by the trade owner. Among other things, you will receive a message from the business advertisement: the responsible tax office, the Chamber of Commerce or the Chamber of Crafts, the professional association, the State Office for Occupational Safety and Health. This notification does not replace a special reporting obligation; In particular, a registration with the Chamber of Crafts is still required for craft businesses. The entry in the commercial register does not replace / contain the notification according to § 14 GewO (notification obligation).
