Residence permit granted for exceptional hardship cases for reasons of international law, humanitarian or political law

You are in possession of a residence permit. An extension of your residence permit cannot be renewed in accordance with the general rules. A residence permit under other regulations is also out of the question. This residence permit can then be extended if, due to special circumstances of the individual case, leaving the federal territory would be an exceptional hardship for you. There must also be the general conditions for granting a residence permit (in particular livelihood security, clarified identity, no interest in expulsion). The residence permit does not entitle you to work. It may be permitted on request by the immigration authority. A residence permit may be issued to them. You are entitled to social benefits (basic security for jobseekers under the Social Code II or basic insurance in old age or in the event of disability under social code XII) and child benefit. Family reunification is excluded. You are not entitled to participate in an integration course. They can only be admitted to participation within available course places.

An exceptional hardness can only be assumed if you are in an emergency that is clearly different from that of other foreigners.

As a rule, you must apply for the extension of your residence permit in person due to an exceptional hardship. Arrange a preliminary meeting with the local immigration authority.
