Advertisement on trade in plant protection products

The notification of the placing on the market / trade in plant protection products can be made in Brandenburg at the State Office for Rural Development, Agriculture and Land Reorganization (LELF), Dept. Plant Protection Service.

Plant protection products are intended to protect plant products and plants, in particular crops (such as arable crops, viticulture or fruit growing) from harmful organisms and other adverse effects. Plant protection products may only be used if their use is not expected to have harmful effects on human and/or animal health or on groundwater. Other significant harmful effects, especially on the natural balance, must also be excluded. Plant protection products may only be used on open-air land if they are used for agricultural, forestry or horticultural purposes. However, they shall not be used in or directly on surface and coastal waters.

Before commencing any commercial activity involving plant protection products, this must be notified to the authority responsible for the place of business and the place of activity. The obligation to notify exists if one wants to use the plant protection products for others or if other persons want to advise on the use of plant protection products within the framework of economic enterprises. It is not not notifiable when handling plant protection products at the occasional neighborhood help.
Likewise, one must notify the competent authority before commencing the activity if one wants to place plant protection products on the market or import them for commercial purposes or in the context of other economic enterprises.

According to the Plant Protection Act (PflSchG), the use of plant protection products is only permitted to persons who have the necessary professional knowledge and skills and can guarantee that no avoidable harmful effects on nature, humans and animals occur through the handling of plant protection products. The plant protection expertise must therefore be proven by persons who

  • use plant protection products on an agricultural holding (including horticulture or forestry) or for the protection of stocks,
  • carry out a notifiable activity (e.B. supply plant protection products in the retail trade or provide commercial advice on the use of plant protection products) or
  • Instruct or supervise persons who use plant protection products as part of a training relationship.
  • Name and address of the holding and of the holder or manager
  • Place of activity
  • Name and proof of the required professional knowledge and skills (certificate of competence) of the persons dealing in plant protection products

Preconditions

Valid certificate of competence

Plant protection products may only be placed on the market by persons who have a valid certificate of competence for the supply of plant protection products.
The registration number of the certificate of competence must be entered on the form.

A corresponding certificate of competence can be applied for under www.pflanzenschutz-skn.de.

Notification of trade in plant protection products shall be made in writing using the form provided:

- Download the form from www.isip.de/psd-bb > forms and applications in plant protection and print it out or fill it out on the computer.

- Fill in the form, sign and attach the copy of the certificate of competence (both sides).

- Submit the documents to the State Office for Rural Development, Agriculture and Land Reorganization (LELF), Unit 31 (General Plant Protection).

- You will receive a registration number and a fee notice by post.
