Building load list

Building loads are public-law declarations of obligation by which the respective landowners undertake to do, tolerate or refrain from doing so on their property. Thus, the buildability or extension of the usability of another property is made possible. Typical construction loads are the road construction load, the space surface construction load as well as the union construction load, through which several parcels are combined into a uniform building plot. The building load declaration therefore normally burdens one property in favour of another. The building load list shows for which land there are restrictions under public law on the use of land.

Hints
Until the introduction of the building loads in 2016, the legal safeguarding of obligations was carried out by means of limited personal servitude, which remain valid.

Building loads can affect the value of a plot of land because they regularly affect its structural exploitability. If there is a legitimate interest, an extract from the building load list can be requested.

The signature under a building load declaration must be made personally with the building inspectorate or must be publicly certified. The construction load becomes legally effective with the entry in the building load list and can only be deleted if the reason for the registration no longer exists (e.g. the building for which a spacer construction load has been registered has been demolished).
