Maintenance advance approval
You will receive the maintenance advance for your child if you raise them in your household without another parent against whom the child is entitled to maintenance. However, this maintenance is not paid, incompletely or irregularly by the other parent/maintenance obliged. The child's centre of gravity must be clearly in your household. You must not have married a new partner. If the subscription requirements are met, you will be paid the maintenance advance until your child reaches the age of majority. The limit on the reference period (previously a maximum of 72 months) has been lifted. The amount of the maintenance advance depends on the amount of the minimum maintenance. Currently, the following amounts apply: for children up to 5 years EUR 165 per month for children from 6 to 11 years EUR 220 per month for children from 12 to 18 years EUR 293 per month After the age of 12, your child is entitled to maintenance only if one of the following conditions is met: You or your child do not receive unemployment benefit II. The maintenance advance can help your child to avoid. They have a gross monthly income of at least EUR 600 and receive supplementary unemployment benefit II. This ensures that all children receive maintenance advances without any gaps if necessary. At the same time, an important incentive is created for households which are not in need of assistance or who could become independent of basic benefits through their own income.
In addition to the application form, it is required to: the birth certificate of the child concerned the identity card of the single parent in the case of foreign children/parents: ID card and valid proof of residence permit the registration confirmation or registration register information the maintenance title: current maintenance certificate, judgment, decision in the event of a marriage: divorce judgment or decision If necessary, letter from the lawyer about the time of separation in the case of unmarried parents: paternity recognition or determination Proof of income on: Child semi-orphan's pension if necessary maintenance payments if applicable if applicable, authorisation/recruitment notices for benefits under the Maintenance Advances Act of other maintenance advances From the age of 12 for current SGB II benefits: full up-to-date decision of the Jobcentre From the age of 15: school certificate or proof of income from the end of school attendance
The competent maintenance advance authority shall provide the relevant application forms.
The following conditions for the granting of maintenance advances must be met: Child maintenance is not paid or only incompletely. Your child is domiciled or habitually resident in Germany. Your child is domiciled or habitually resident in the EU/EEA abroad or in Switzerland. In that way, the single parent must pursue not only minor employment in Germany and establish an unlimited income tax obligation in Germany due to the residence of the single parent. The parent is a single parent (e.g. also widowed). The parent and the child must live in a household. Foreign children are only entitled to certain residence permits.
Children between the ages of 12 and 18 are only entitled to a maintenance advance if the child is not dependent on SGB II benefits or if the single parent earns his own income of at least EUR 600 gross in the SGB II reference.
After full application, the eligibility requirements will be examined by the maintenance advance authorities. If these are fulfilled, maintenance advance shall be granted accordingly.
