Purpose

The goal is to create affordable rental housing for households that are unable to find suitable housing on the open market. Recognized refugees are to be given appropriate consideration in this process.

Scope

Funding is provided for

the creation of rental housing through new construction, renovation, or expansion of buildings, including those not previously used for residential purposes,
the modernization of existing rental housing,
the acquisition of vacant buildings to carry out measures under sections 2.1 and 2.2 or the initial acquisition of residential buildings, as well as
preparatory planning measures (including, in particular, housing concepts, expert reports, and design competitions).

Grant Recipients

Grant recipients may include: Municipalities—including within the framework of municipal cooperation (for example, as a special-purpose association or based on a special-purpose agreement), provided that only municipalities are involved. Counties and districts, if the subsidized housing is intended for their own employees or serves to attract new employees. Grant recipients must be the owners of the subsidized housing. To implement the project, they may, in particular, utilize municipal housing construction companies. Churches may, as cooperation partners, provide land through a leasehold interest.

Eligible Costs

Eligible costs depend on the measure. For measures under Nos. 1 through 3, the total costs of the measure are eligible for funding in accordance with §§ 5 through 8 of the Second Calculation Ordinance (II. BV); these include the costs of the building lot, construction costs, and ancillary construction costs. For measures under No. 2, the costs of necessary repairs may also be funded. The land and the residual value of the building are not eligible for funding if the building is already owned by the municipality. For measures under No. 4, the necessary costs and fees are eligible for funding.

Type and Amount

Funding is provided in the form of a loan.

Funding for measures under Nos. 1 through 3 is provided as project funding for the entire measure through partial financing via a grant of up to 30% of the total eligible costs and a low-interest capital market loan from the Bayerische Landesbodenkreditanstalt in the amount of up to 60% of the total eligible costs.
For building alterations, expansions, and modernizations, the grant may be increased to up to 40% of the total eligible costs.
If at least 60% of the subsidized housing units are intended for professionals in essential public services or to attract such professionals, the grant may be increased by up to 5 percentage points.
The grant may also be applied for without the loan.
In the case of funding for the acquisition of land under No. 3, the amount of the grant is limited to the amount of the eligible costs of the measures under Nos. 1 and 2.
Funding for measures under No. 4 is provided through a grant amounting to 60% of the total eligible costs.

Preconditions

Only projects that have not yet begun are eligible for funding. Upon request, the granting agency may, in exceptional cases, grant approval for the project to begin early—or, if applicable, for individual components — if the project’s financing, including the grant to be awarded, any pre-financing costs, and follow-up costs, appears sufficiently secured; the measure has been substantively reviewed; and the eligibility requirements for the grant are met, subject to a final review.
The rental apartments must meet generally accepted housing standards.
Funding may only be provided at locations with a significant, non-temporary need for rental housing for the group of persons specified in No. 9, sentences 1 and 2, of the Guidelines for the Municipal Support Program for the Creation of Rental Housing in Bavaria.
For projects under No. 3, the initial purchase of a residential building is eligible for funding only if the building permit for the building was issued after October 9, 2015, and the building has not yet been used for residential purposes. For buildings constructed without a building permit, the date of commencement of construction as indicated in the notice of commencement of construction shall be deemed to replace the building permit.

All Bavarian municipalities are eligible to apply. The municipalities must remain the owners of the subsidized residential buildings but may commission third parties, such as municipal or church-affiliated housing companies, to implement the measures (in accordance with public procurement law, where applicable). It is not possible to transfer the funds to third parties, such as municipal housing companies. Municipalities may also implement projects through intermunicipal cooperation.

There are no costs involved.

Procedure

The grant application must be submitted to the relevant district government using the application form and including the documents specified therein (e.g., planning documents, explanatory notes, cost and financing plan). The government reviews the eligibility requirements for funding and selects the projects within the limits of the budgetary funds made available to it. It conducts the approval process and issues the notice of approval.

For projects under Nos. 1 through 3, it forwards the grant approval notice along with the supporting documents to the Bavarian State Land Credit Institution for immediate dispatch; for projects under No. 4, it sends the notice directly to the municipality. The State Government arranges for the disbursement of the funding and reviews the statement of use.

The application must be submitted before the project begins.
