The BioSt-NachV serves to implement Directive 2009/28/EC of the European Parliament and of the Council of April 23, 2009, which defines the requirements for the remuneration of electricity from liquid biomass in accordance with Section 27 (1) of the Renewable Energy Sources Act.

Certification systems ensure organizational compliance with the sustainability criteria in the bioenergy sector for the production and supply of biomass and contain specifications for defining the sustainability requirements in more detail, for providing proof of compliance and for monitoring this proof. They set out requirements for the implementation of the sustainability criteria. Every company or operating site involved in the production and supply of biomass that complies with the ordinance must have undertaken to comply with the requirements of a recognized certification system in the bioenergy sector.

Certification systems are recognized for this purpose upon application.

Documents on the fulfillment of the requirements of § 33 BioSt-NachV

Preconditions

Designation of:
- a natural or legal person who is organisationally responsible,
- an address for service in a Member State of the European Union or in another State party to the Agreement on the European Economic Area,
- certification bodies recognised under the BioSt-NachV and using the relevant certification system,
- countries and states to which they refer;
Suitability to ensure that the requirements under Articles 17 to 19 of Directive 2009/28/EC are met;
Accuracy, reliability, protection against misuse, assessment of the frequency and method of sampling and the reliability of the data;
Ensuring adequate and independent verification of the data and evidence of such verification;
Existence of standards at least equivalent to the requirements set out in Annex III to the Agreement on Technical Barriers to Trade (OJ L 336, 23.12.1994, p. 86) and the requirements set out in Appendix 5 to the Sustainability Regulations.
