All Germans in accordance with Article 116 Paragraph 1 of the Basic Law and all nationals of the other Member States of the European Community (EU citizens) who, on election day
- have reached the age of 18,
- have had their residence in the electoral area for at least three months according to the population register, their main residence if they have more than one residence, or otherwise habitually reside there without having a residence,
- are not excluded from the right to vote.
Anyone who has been convicted by a German court of law and is therefore unable to hold public office and obtain rights from public elections is not eligible to vote. Citizens of the Union are also ineligible if they are not eligible to vote as a result of an individual civil or criminal law decision in their home Member State.
