Notification is not required for the construction of

• Installations for which a suitability assessment has been applied for in accordance with Section 63 of the Federal Water Act (WHG),
• other installations that are the subject of an approval procedure under other legislation (e.g. under the Federal Immission Control Act or building law), provided that compliance with the requirements of the AwSV is also ensured in the approval procedure.
  
  In these procedures, the participation of the competent authority can be ensured within the authorities.
