Foods for special medical purposes, infant formula, and certain follow-on formulas must meet specific legal requirements regarding food safety and consumer protection. This applies to the manufacturing and labeling of these products, as well as their offering for sale.
You must therefore report the following cases to the Federal Office for Consumer Protection and Food Safety (BVL):
- Initial notification:
- You are placing the product on the German market for the first time or offering it for sale.
- You must submit a separate notification for each product.
- Amendment notification:
- The product that has already been notified has a modified formulation.
- You are adjusting the recommended serving sizes.
- Your company has a new address.
- Second Notification:
- The product has already been notified in another EU member state, and you wish to place the product on the market in Germany for the first time.
The BVL forwards your information to the competent authorities in the federal states as well as to the Federal Ministry of Agriculture, Food, and Home Affairs (BMLEH). The competent authorities in the federal states monitor compliance with legal requirements. As a company, you are responsible for implementing these requirements.
